Reinstaurarea autoritatii parintesti comune este un drept al copilului / caz judecat la Cluj

Domnului / Doamnei preşedinte a judecătoriei Cluj,

Prin prezenta dorim să ne exprimăm cele mai sincere felicitări pentru modul profesionist în care a fost tratat dosarul 8921/211/2012 de către judecătorii din cadrul instanţei domnul George Barbura Turcu şi doamna Maria Gabriela Mot. Am avut posibilitatea să citim sentinţa emisă în acest dosar şi am fost plăcut impresionaţi de modul în care instanţa a penetrat cazul şi a înţeles să discearnă interesul superior al unui copil cu părinţii în ţări diferite şi în care părinţi sunt într-un conflict deschis. Considerăm că în mod cât se poate de corect instanţa a reţinut faptul că NU constituie un motive temeinice de a refuza mamei (care anterior a pierdut exerciţiul autorităţii părinteşti pe vechiul cod al familiei) reinstaurarea autorităţii părinteşti:
– faptul că aceasta ar suferi de epilepsie,
– faptul că aceasta locuieşte în alt stat sau
– faptul că între părinţi există diferenţe de opinie / conflicte privitoare la modul în care copilul ar trebui să fie crescut şi educat.
Ne bucură să observăm că sentinţă emisă urmează atât litera cât şi spiritul noilor prevederi introduse de codul civil şi legea 257/2013 (la care ARPCC a fost co-autor).

Dorim să vă asigurăm, atât pe dvs. cât şi pe juraţii care activează în cadrul judecătoriei Cluj de întreaga noastră consideraţie.

Hello Everyone,

We just “finished” with the Judecatoria Cluj-Napoca, hope that the father will be smart enough for not doing an appeal.

Marcel will stay with him (no problem for us)

I’m not fully satisfied with the decision (I will tell later why) but the most important was the interest of the child,… and it has been respected.

Marcel has now 2 “full” parents.

I would like to thank you all and especially Codin, but I told him at the begining (almost 2 years ago) the Job that he did was a goldmine for me (and for everyone too).

We have gone throught a lot of up and down, and a lot of stress.

If I read the decision, I can clearly say that behind the name of the Judge George Barbura Turca (who did only the last 2 sedinte), there is the name of Judge Maria Gabriela MOT who did a very nice job, most probably she spent a lot of time on ARPCC Blog 🙂 she doesn’t need to be trained 🙂 and I can say that she understood what a child needs (you don’t need to be a judge to understand that) and she didn’t care about the egoism of one parent, unfortunately this judge is now in Tribunal Penal (this is what they told us).

I think that this kind of Judge should be at all level Judecatoria/tribunal/curtea d’apel, to stop all the parents who ask for sole custody.

PS : 2 additional aspects

– I was not satisfied with the Autoritate Tutelara so we will continue to write to them to obtain a better explanation
“Numitul MR afirma ca nu este de acord cu exercitarea in comun a autoritatii parintesti”
so the concluzii-Propuneri were “este in interesul minorului MM ca tatal sa isi exercite singur autoritatea parinteasca” this kind of conclusion should be published (the full text should be published) !!! no motivations at all except “Tata nu este deacord”,… and they are supposed to work in the interest of the child,… here it was clearly in the interest of one parent (fortunately Judge Maria Gabriela Mot saw that).
– As the father didn’t give any information on Marcel’s school, we wrote directly to the school, the reply from the school was VERY POSITIVE, so it should be published too.
